These Terms and Conditions generally and bindingly regulate the behavior that LICENSE HOLDERS and END USERS must have in relation to the PLATFORM and SOFTWARE, without prejudice to those duties and obligations imposed by good faith and general or special laws of each COUNTRY OR TERRITORY FOR T&C. The Terms and Conditions will apply to the PLATFORM and SOFTWARE, including all applications or services that run within this environment; unless special or particular Terms and Conditions are established for each of them. Likewise, this document establishes other complementary and binding conditions. Additionally, Rewellth assumes a special commitment to the protection and responsible and confidential treatment of Protected Health Information (PHI) of our users. User Virtual Practice Account To access and use the Rewellth-HUB platform, healthcare providers must create an authorized user account, including truthful and updated information such as full name, valid email address, and mobile phone number. Account activation is subject to verification of the provided email address. Rewellth reserves the right to create, disable, and/or delete user accounts as necessary to maintain the integrity and security of the platform.
Responsible Use and Application Security User Commitment: Users of the Rewellth-HUB platform commit to using the mobile and web applications responsibly, respecting the guidelines established to ensure a safe and effective environment for all. It is essential that each user:
- Maintain the confidentiality of their access credentials, avoiding sharing their username and password with third parties.
- Refrain from attempting unauthorized access to restricted areas of the platform, as well as to systems or data beyond their authorization.
- Avoid introducing any type of malicious software, virus, or code that could harm, alter, or compromise the security or functioning of the Rewellth-HUB platform.
- Use the platform and its services exclusively for the intended purposes, respecting intellectual property rights and avoiding any form of fraudulent or malicious use. Platform Security: Rewellth commits to implementing advanced security measures to protect the integrity of the platform and the privacy of users’ data. However, security also depends on responsible use by users. Therefore, we urge everyone to follow best security practices and report any suspicious activity or security breach to our technical support team immediately. Consequences of Inappropriate Use: Any violation of the rules of responsible use and security may result in temporary suspension or permanent termination of access to the platform by the offending user. Rewellth reserves the right to take legal action in cases of serious infractions that compromise the security or integrity of our platform and the data it hosts.
Use of Virtual Practice by Healthcare Providers The Rewellth-HUB platform provides healthcare providers, including support and administrative personnel authorized by Rewellth, the use of a virtual practice based on web and mobile. This practice is designed to facilitate the provision of advisory and medical care services to licensee-patients. All healthcare providers must adhere to policies and procedures established by Rewellth to ensure quality care and compliance with all applicable regulations.
Binding Force These Terms and Conditions acquire their binding character for the END USER from the moment they access the REWELLETH-HUB PLATFORM or SOFTWARE, that is, from the instant the user enters its homepage or when they enter their username and password, as applicable. If they disagree with them, it is the responsibility of the END USER to refrain from using it. It is the duty of the END USER to consult the current Terms and Conditions each time they access the SOFTWARE.
Compliance with App Store Policies Rewellth commits to comply with all policies and requirements set by the Google Play and Apple App Store in the distribution and operation of our mobile applications. This includes adhering to current guidelines on data protection, payment transactions, and privacy policy: Data Protection: We ensure that the handling and protection of our users’ personal and health data are carried out in full compliance with international regulations, including GDPR and HIPAA, and the specific requirements of the app stores. Payment Transactions: All payment transactions within our applications comply with security standards and the policies of the app stores, ensuring secure and protected transactions for our users. Acceptable Use Policy Users of Rewellth-HUB commit to adhering to our Acceptable Use Policy, avoiding any conduct that may compromise the security or proper functioning of the platform. This includes, but is not limited to, maintaining the confidentiality of access credentials, not attempting unauthorized access to systems or data, and refraining from introducing malicious code. Violations of this policy may result in the suspension or termination of access to the platform.”
Declaration The END USER/LICENSEE acknowledges and agrees that their relationship with Rewellth, as the holder of the intellectual property rights of the PLATFORM and/or SOFTWARE, is limited solely to the authorization provided by this company through the USE LICENSE. Specifically, the END USER/LICENSEE does not establish nor will establish any commercial relationship, technical support, warranty, or other nature with Rewellth. Any matter unrelated to these Terms and Conditions must be dealt with directly with the AUTHORIZED CHANNELS OR MERCHANTS through which the USE LICENSE was acquired. Consequently, the END USER/LICENSEE understands and agrees that any claim must be directed to them and not to Rewellth nor its affiliated companies.

- Applicable Legislation for Colombian Law These Terms and Conditions are governed by Colombian law, including, but not limited to, Law 1581 of 2012 and Decree 1377 of 2013, which establish the framework for the protection of personal data and the principles of habeas data and privacy in accordance with the Colombian Constitution. Additionally, for those services that require it, we also collect Protected Health Information (PHI), comprising data related to health status, medical history, or any other relevant health information from our users. In addition to our robust encryption measures, Rewellth uses the WebRTC service to facilitate secure video consultations. This advanced service ensures secure transmissions through encrypted connections and regenerated security tokens, effectively protecting both voice and video data. During each session, random AES keys are generated by clients at the start of the multimedia connection, and, to further enhance security, additional keys are generated periodically throughout the session. Data transmission employs Transport Layer Security (TLS) for encryption, using the SRTP protocols for media traffic and DTLS-SRTP for key negotiation, both defined by the IETF, with 128-bit AES encryption for audio and video, and HMAC-SHA1 to verify data integrity. These measures ensure the privacy and security of communication during video consultations, demonstrating our ongoing commitment to protecting our users’ information.

If a solution is not reached within a reasonable period, the controversy, dispute, or claim will be submitted to arbitration under the rules of the Cali Chamber of Commerce, Colombia, and the arbitration will be conducted in Spanish, in Cali, Colombia. The decision of the arbitrator will be final and binding for both parties. Additionally, it specifically establishes that arbitration will be conducted in Cali, Colombia, under the rules of the local Chamber of Commerce, which is important to ensure that the appropriate regulations and procedures are followed in that jurisdiction.
Conflict Resolution Procedures: In the event of a conflict or dispute related to the services provided through Rewellth-HUB, licensee-patients should initially attempt to resolve the matter directly with Rewellth through written communication at customerservice@rewellth.com. If a satisfactory resolution is not reached, the parties may opt for a mediation process or, ultimately, submit the dispute to arbitration in Colombia, in accordance with applicable Colombian laws. This conflict resolution procedure does not limit the rights of licensee-patients to seek legal remedies under applicable laws.
Rewellth reserves the right to modify these Terms and Conditions at any time. When significant changes are made, licensee-patients will be notified through a prominent notice on the Rewellth-HUB platform and/or by email. Licensee-patients will be considered to have accepted the changes to the Terms and Conditions if they continue to use the platform after the publication or notification of such changes.
